Marvelux Getaways LLC Terms & Conditions

The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to Marvelux Getaways and the term "you" refers to the individual who signs this agreement. The terms "your itinerary", "your trip", "this trip", "room booked", and "roommate" refer to all services rendered.

By clicking “I Agree” / proceeding with booking on your itinerary as part of the booking process, you hereby agree to the following terms and conditions, on behalf of yourself and all members of your traveling party. These terms and conditions form an agreement between you and Marvelux Getaways, LLC. (“Marvelux Getaways,” “we” or “us”).

You agree:
a) you are 21 years of age or older
b) you have read these terms and conditions
c) you consent to our use of personal data in accordance with our Privacy Policy to book your travel only and are authorized on behalf of all persons named on the booking to disclose their personal details to us, including where applicable, special categories of data (such as information on health conditions or disabilities and dietary requirements); and
d) you accept financial responsibility for payment of the booking on behalf of all people named in the booking.


Travel Proposals and Quotes
Provision of Quotes: Marvelux Getaways LLC. provides travel quotes and proposals based on the information available at the time of request. Quotes are provided as an estimate and may be subject to change based on availability, fluctuations in prices, or changes in travel conditions.

Validity of Quotes: All quotes are valid for a specified period as indicated in the proposal. After the validity period expires, prices and availability are subject to change. Clients are encouraged to confirm the validity of the quote before finalizing their booking. Once a quote is expired, a new quote form is necessary.

No Obligation: Receiving a travel proposal or quote does not constitute a confirmation or guarantee of availability. A formal booking and payment are required to secure travel arrangements. Marvelux Getaways LLC. reserves the right to adjust or withdraw quotes if there are changes in travel conditions or supplier rates.

Accuracy of Information: While Marvelux Getaways LLC. strives to provide accurate and up-to-date information in all travel proposals and quotes, errors or omissions may occur. Marvelux Getaways LLC. is not responsible for any inaccuracies or discrepancies in the information provided.

Changes and Cancellations: Any changes to a confirmed booking may affect the quoted price. Additional charges may apply if changes are made after a quote is accepted. Cancellations are subject to the terms and conditions of the respective travel providers and may incur penalties or fees.

Third-Party Providers: Travel proposals and quotes may include services provided by third-party suppliers, such as airlines, hotels, or tour operators. Marvelux Getaways LLC. acts as an intermediary and is not liable for the performance or quality of services provided by these third parties.

Confirmation of Booking: To finalize and confirm a booking, clients must accept the quote and make the necessary payment as per the instructions provided. Confirmation of the booking will be issued once payment has been received and processed.

Amendments to Quotes: Marvelux Getaways LLC. reserves the right to amend quotes based on changes in availability, pricing, or other factors affecting the travel arrangements. Clients will be notified of any amendments and given the opportunity to accept or reject the revised quote.


General Booking Terms
Booking Process: To book travel services with Marvelux Getaways LLC., clients must provide all necessary information, including travel dates, destinations, and any special requirements. A booking request will be processed once all required information is received.

Confirmation of Booking: A booking is not confirmed until a written confirmation is issued by Marvelux Getaways LLC.. This confirmation will include details of the travel arrangements and payment instructions. Clients should review the confirmation carefully to ensure accuracy.

Payment Terms: Full payment or a deposit, as specified in the booking confirmation, is required to secure the booking. Payment methods accepted include [Stripe Payment Processing]. The balance of the payment must be received by Marvelux Getaways LLC. as per the payment schedule outlined in the booking confirmation/ invoice.

Changes to Bookings: Any request for changes to a confirmed booking must be made in writing and is subject to availability and additional fees. Changes may affect the cost of the booking and the terms of travel. Marvelux Getaways LLC. will inform clients of any additional charges or alterations resulting from the requested changes.

Cancellation Policy: Cancellations are subject to the terms and conditions of the respective travel providers and may incur penalties or fees. Clients must notify Marvelux Getaways LLC. in writing to cancel a booking. Refunds, if applicable, will be processed according to the cancellation policy of the travel providers and Marvelux Getaways LLC..

Travel Insurance: Clients are encouraged to purchase travel insurance to cover potential risks, including trip cancellations, medical emergencies, and loss of personal belongings. Marvelux Getaways LLC. does not provide travel insurance and is not responsible for any losses or damages incurred during the trip.

Travel Documentation: Clients are responsible for ensuring they have the necessary travel documents, including valid passports, visas, and any required health documentation. Marvelux Getaways LLC. will provide general information but is not liable for issues related to travel documentation.

Liability: Marvelux Getaways LLC. acts as an intermediary between clients and travel service providers. We are not liable for any actions or omissions of third-party providers, including but not limited to airlines, hotels, and tour operators. Our liability is limited to the services provided directly by Marvelux Getaways LLC..

Force Majeure: Marvelux Getaways LLC. is not liable for any failure to perform our obligations under these terms due to circumstances beyond our control, including but not limited to natural disasters, political unrest, or travel restrictions.

Governing Law: These terms and conditions are governed by the laws of New Jersey. Any disputes arising from bookings shall be subject to the jurisdiction of the courts in Essex County.


Deposits
A deposit is required to secure vacation packages or individual travel components booked through Marvelux Getaways LLC.. The amount of the deposit will be specified in the booking confirmation and is required at the time of booking. Deposits must be paid according to the payment instructions provided in the booking confirmation. The deposit amount is non-refundable, except where specified otherwise by the travel providers or under certain circumstances outlined in our cancellation policy.

Final Payment: The remaining balance of the total booking cost is due 30-45 days prior to the travel date, as specified in the booking confirmation. Failure to make the final payment by the due date may result in the cancellation of the booking and forfeiture of the deposit.

Cancellation and Refunds: In the event of cancellation, the deposit is subject to the terms and conditions of the travel providers and Marvelux Getaways LLC.’s cancellation policy. Refunds for deposits, if applicable, will be processed according to these policies.

If you’ve opted for the deposit installment plan, your deposit is valid for 1 month from final installment date if for any reason you are no longer able to travel.


 

Payments / Payment Methods Accepted

Accepted Payment Methods: Marvelux Getaways LLC. accepts payments exclusively through the following payment processors:

  • Stripe

  • Travefy


Payment Processing: All transactions must be processed through one of the approved payment methods listed above. We do not accept payments via other platforms, zelle, cash-app, venmo, PayPal, checks, or cash for vacation packages.

If the payment method is not listed here, we do not accept it.This will allow our clients to make payments through these various platforms with major debit / credit cards and ACH/WIRE transfer via their bank account. All clients also have the option of requesting affirm or uplift if applicable to pay for the desired itinerary.

Payment Security: Payments made through Trave-Joy, Stripe, or Travefy are processed using secure and reliable payment systems. Marvelux Getaways LLC. is not responsible for any issues related to the payment processing systems used by these platforms.

Transaction Fees: Any fees or charges associated with using Trave-Joy, Stripe, or Travefy for payment processing are the responsibility of the payer. Marvelux Getaways LLC. will not cover or reimburse such fees.

Payment Confirmation: Upon successful completion of a payment through one of the accepted methods, you will receive a confirmation email from the respective payment processor. It is your responsibility to ensure that the payment confirmation is received and accurate.

Changes to Payment Methods: Marvelux Getaways LLC reserves the right to update or change the accepted payment methods at its discretion. Any changes will be communicated to clients in advance and reflected in the updated terms and conditions

Check-In Procedures for Resorts, Hotels, and Cruises
Check-In Requirements: Clients must adhere to the check-in procedures and times set by the resort, hotel, or cruise operator. Typically, check-in times are between 03:00 pm - 04:00 pm and check-out times are between 10:00 am - 12:00 pm, but exact times may vary. It is advisable to confirm the specific check-in/out time with the property or cruise operator prior to arrival.

Identification and Documentation: At check-in, clients will be required to present valid photo identification and, in some cases, a credit or debit card for incidentals or deposit purposes. For cruises, clients may also need to provide additional documentation such as a passport or visa if traveling internationally.

Reservation Confirmation: Clients should ensure they have a copy of their booking confirmation / digital itinerary, which includes details of their reservation. This confirmation can be presented at check-in to facilitate a smooth process.

Early Check-In / Late Check-Out: Requests for early check-in or late check-out are subject to availability and may incur additional charges. Clients should make these requests directly with the resort, hotel, or cruise operator in advance.

Fees and Deposits: The resort, hotel, or cruise operator may require a deposit or hold on a credit card at check-in for incidentals or potential damages. This amount varies by property and operator. Clients are responsible for any charges incurred during their stay or cruise.

Special Requests: Any special requests or accommodations should be communicated directly to the resort, hotel, or cruise operator at the time of booking or as soon as possible. Marvelux Getaways LLC. will assist in forwarding special requests but cannot guarantee their fulfillment.

Non-Arrival: In the event of a no-show or failure to check-in as scheduled, the resort, hotel, or cruise operator's cancellation and no-show policies will apply. Clients should refer to their booking confirmation for specific details on these policies.

Contact Information: For any issues or questions related to check-in procedures, clients should contact the resort, hotel, or cruise operator directly. Contact information for these operators will be provided in the booking confirmation.

Passport Status for International Travel
Passport Validity: Clients are responsible for ensuring their passport is valid for the duration of their trip. For international travel, many countries require that passports be valid for at least six months beyond the planned date of departure. It is the client's responsibility to verify and comply with these requirements.

Visa Requirements: Clients must also ensure they have the necessary visas for their destination(s). Visa requirements vary by country and nationality, and it is the client’s responsibility to check and obtain any required visas before traveling. Entry requirements are ever changing so it is possible for the advised entry requirements at time of booking change before actual travel.

Documentation Check: Marvelux Getaways LLC. recommends clients review their passport and visa status well in advance of their travel dates. Clients should confirm that their passport is in good condition, free of damage, and contains the required pages for entry and exit stamps.

Passport Renewal: Clients should allow sufficient time for passport renewal if their passport is close to expiration. Processing times for passport renewals can vary, so clients are encouraged to apply for renewal as early as possible.

Assistance and Information: Marvelux Getaways LLC. provides general information regarding passport and visa requirements but does not guarantee accuracy or completeness. Clients should consult the relevant embassy or consulate for the most up-to-date information and specific requirements.

Responsibility: Marvelux Getaways LLC. is not liable for any issues or complications arising from passport or visa problems, including but not limited to entry denial, fines, or travel delays. It is the client’s sole responsibility to ensure all travel documents are in order.

Travel Restrictions: Clients should be aware of any travel restrictions or entry requirements related to health, security, or other factors. This may include COVID-19 testing, vaccinations, or quarantine measures.

Contact Information: For questions regarding passport and visa requirements, clients are advised to contact the relevant embassy or consulate of their destination. Marvelux Getaways LLC. is available to provide general guidance and assistance as needed.

TSA and Identification Requirements
Identification for Travel: Clients are responsible for ensuring they have the appropriate identification required for their travel. This includes, but is not limited to, government-issued photo identification such as a driver's license or passport, depending on the nature of the trip and the travel destination.

TSA Requirements: For domestic flights within the United States, clients must adhere to the Transportation Security Administration (TSA) regulations, which require presenting valid photo identification at airport security checkpoints. The accepted forms of identification are detailed on the TSA website and may include a state-issued driver's license, passport, or other approved forms of ID.

International Travel Documentation: For international travel, clients must present a valid passport and, if applicable, a visa at check-in and security checkpoints. It is the client's responsibility to ensure that all travel documents comply with the entry and exit requirements of the destination country.

Name Discrepancies: The name on the client’s identification must match the name on their travel booking. Any discrepancies between the name on the identification and the booking may result in delays or denial of boarding. Clients should ensure that their booking details are accurate and reflect their identification.

Lost or Stolen Identification: In the event of lost or stolen identification, clients should immediately report the loss to the appropriate authorities and follow their procedures for obtaining a replacement. Marvelux Getaways LLC. cannot assist with or be held responsible for issues arising from lost or stolen identification.

Responsibility: Marvelux Getaways LLC. provides information and guidance regarding TSA and identification requirements but is not liable for any issues or disruptions related to client identification or TSA procedures. It is the client’s responsibility to ensure they comply with all identification requirements and travel regulations.

Updates and Changes: Clients should stay informed about any updates or changes to TSA and international travel identification requirements. Marvelux Getaways LLC. will provide general guidance but cannot guarantee the accuracy of information provided by external authorities.

Contact Information: For questions related to TSA regulations or travel identification requirements, clients should contact the TSA, relevant airport authorities, or their travel provider directly.

Charge-backs
1. Definition and Scope: A chargeback occurs when a credit card holder disputes a charge with their credit card issuer, requesting a reversal of the transaction. Chargebacks can be initiated for various reasons, including but not limited to, fraudulent transactions, unrecognized charges, or dissatisfaction with services.

2. Responsibilities of the Client:

Before Initiating a Chargeback: Clients are required to contact our agency directly to address any issues or concerns regarding their transactions. We are committed to resolving disputes and providing assistance to ensure customer satisfaction. Failure to do so will result in immediate business relationship termination.
Resolution Attempts: Our agency will make reasonable efforts to resolve any disputes through direct communication before a chargeback is pursued. This includes providing refunds, adjustments, or other resolutions where appropriate.
3. Impact of Chargebacks:

Fees and Penalties: Initiating a chargeback may result in additional fees or penalties imposed by the credit card issuer. These costs are typically the responsibility of the client.
Account Standing: Repeated chargebacks or chargebacks for unjustified reasons may affect the client’s standing with our agency and will result in restrictions on future transactions.
4. Agency’s Rights:

Dispute Response: Our agency reserves the right to contest any chargebacks that we believe to be unjustified. We will provide evidence and documentation to the credit card issuer to support our position.
Refunds and Adjustments: Refunds or adjustments resulting from chargebacks will be processed in accordance with our agency's refund policies and are subject to review.
5. Acknowledgment and Acceptance: By booking with our agency, clients acknowledge and accept these terms and conditions related to chargebacks. Clients agree to follow the outlined procedures.


Release of Liability for Failure to Read Communications

Responsibility for Communication Review: Clients are responsible for reviewing all communications and emails sent by our travel agency Marvelux Getaways LLC. regarding their reservations. This includes, but is not limited to, confirmation emails, itinerary details, payment instructions, changes, cancellations, and important updates.

Acknowledgment of Receipt: By booking through our agency Marvelux Getaways LLC., clients acknowledge that they have received and understood the importance of all communications related to their reservations. Clients are expected to read and act upon these communications promptly.

Release of Liability: Our travel agency Marvelux Getaways LLC. is not liable for any issues or inconveniences that arise due to a client’s failure to read, understand, or act upon communications or emails sent regarding their reservations. This includes, but is not limited to:

Incorrect or Missing Information: Any errors or omissions resulting from failure to review and confirm details provided in communications.
Missed Deadlines: Failure to adhere to deadlines for payments, cancellations, or other actions as communicated.
Travel Disruptions: Issues arising from not being aware of changes to travel arrangements or important updates, missed modes of transportation, check-in delays for resorts / cruises, missed activities, etc. Marvelux Getaways LLC. can help with re-booking any component, but the full cost or re-booking fee may be applicable. Marvelux Getaways LLC. does not have control of or cannot disregard other partnered business policies and procedures.

Client Responsibilities:

Regular Monitoring: Clients should regularly check their email and other communication channels for updates from our agency.

 

Immediate Action: Clients must promptly address any issues or discrepancies identified in the communications.
Contact for Clarifications: If there is any confusion or if a communication is not received, clients are responsible for contacting our agency immediately to seek clarification.

 

You agree to take responsibility for ensuring that you stay informed by reviewing all communications from our agency and partnered vendors.

Liability Release for Flight Delays
Marvelux Getaways LLC. is not responsible for any anticipated refund compensation due to travelers for delayed departures, loss of luggage, delayed return flights, loss of auxiliary purchases (such as seats, extra space, in-flight meals), or any other disruption to flights that are not listed here. All travelers must receive compensation through the airline directly and not Marvelux Getaways LLC.. If the airline is unable to compensate for whatever reason, the lack thereof does not and will not be compensated by Marvelux Getaways LLC..

Acknowledgment and Acceptance: By proceeding with your booking, you confirm that you have read, understood, and accepted these terms and conditions.

Scope of Liability: By booking travel through our Marvelux Getaways LLC., you acknowledge and agree that Marvelux Getaways LLC. is not liable for any flight delays or cancellations caused by weather conditions or other uncontrollable factors beyond our control. This includes, but is not limited to, natural disasters, air traffic control issues, and airline operational disruptions.

Insurance Coverage: To mitigate the financial impact of such delays, we strongly recommend that all travelers purchase travel insurance. Insurance can provide coverage for various travel-related issues, including flight delays and cancellations, and may offer compensation or reimbursement for additional expenses incurred as a result.

Compensation and Reimbursements: In the absence of travel insurance, compensation and reimbursements for flight delays will be subject to the airline’s Bill of Rights and their policies regarding compensation. Eligibility for compensation will be determined according to the airline's guidelines and may vary depending on the circumstances surrounding the delay. Marvelux Getaways LLC. cannot change the outcome.

Claim Process: Travelers seeking compensation or reimbursement should directly contact the airline or visit their website for information on filing a claim if insurance was not purchased. Our agency Marvelux Getaways LLC. will assist with the process where possible, but we cannot guarantee compensation or reimbursement.

Acknowledgment and Acceptance: By proceeding with your booking, you confirm that you have read, understood, and accepted these terms and conditions. You also acknowledge that our agency’s liability is limited in cases of flight delays or cancellations caused by factors beyond our control.

Natural Disasters and Hurricane Season

Liability for Natural Disasters: By booking travel through our agency Marvelux Getaways LLC., you acknowledge and accept that our agency is not liable for any disruptions caused by natural disasters, including but not limited to hurricanes, earthquakes, floods, or other severe weather events. This liability extends to both occurrences before departure and during your trip.

Importance of Travel Insurance: We at Marvelux Getaways LLC. strongly recommend purchasing travel insurance to protect against financial losses resulting from natural disasters. Travel insurance can provide coverage for trip cancellations, interruptions, delays, and other expenses that may arise due to such events. Insurance is the most effective way to safeguard your investment and ensure you are compensated for any unforeseen circumstances.

Responsibility for Travel Arrangements: Unless a disruption is officially communicated by the accommodating airline, hotel, cruise line, rental company, or other service providers, travelers remain responsible for completing their travel plans or managing cancellation fees. Our agency Marvelux Getaways LLC. is not liable for any additional costs incurred due to travel disruptions related to natural disasters.

Notification and Claims: In the event of a natural disaster, travelers should promptly contact Marvelux Getaways LLC. for information on delays, cancellations, and possible refunds. For insurance claims, travelers should reach out to their insurance provider directly to understand their coverage and initiate the claims process.

Acknowledgment and Acceptance: By proceeding with your booking, you confirm that you have read, understood, and accepted these terms and conditions. You also acknowledge that purchasing travel insurance is essential for protecting yourself from potential financial losses due to natural disasters and other unforeseen events.

Slip and Fall / Vacation Injury
Responsibility for Safety: Marvelux Getaways LLC. is not responsible for any injuries, including slip and fall incidents, that occur at resorts, hotels, or other accommodations booked through our services. Clients are responsible for exercising caution and adhering to safety guidelines provided by the accommodation.

Notification of Incidents: In the event of an injury or accident, clients should immediately report the incident to the resort or accommodation management and seek appropriate medical attention. It is important to document the incident and obtain a written report from the property management if possible.

Liability: Marvelux Getaways LLC. acts as an intermediary in booking travel arrangements and is not liable for any injuries or accidents that occur on the premises of the resort, hotel, or other accommodations. All liability for such incidents rests with the property management or the responsible parties.

Claims and Compensation: Any claims for compensation or damages resulting from slip and fall incidents or other injuries must be directed to the resort or accommodation management. Marvelux Getaways LLC. is not involved in or responsible for handling claims or compensation related to such incidents.

Travel Insurance: Clients are strongly encouraged to obtain travel insurance that includes coverage for accidents and injuries during their trip. Marvelux Getaways LLC. does not provide insurance and is not responsible for any medical costs or other expenses incurred due to accidents or injuries.

Indemnification: Clients agree to indemnify and hold Marvelux Getaways LLC. harmless from any claims, damages, losses, or expenses arising from slip and fall incidents or other injuries that occur during their stay at the resort, hotel, or other accommodation.

Final Itinerary Policy
A final itinerary will be issued by Marvelux Getaways LLC. once all travel arrangements have been confirmed and payment has been processed. The final itinerary will include detailed information about travel dates, times, accommodations, transportation, and any other relevant details.

Review and Accuracy: Clients are responsible for reviewing the final itinerary upon receipt to ensure that all details are correct. Any discrepancies, errors, or omissions should be reported to Marvelux Getaways LLC. within 1 day of receiving the final itinerary.

Changes and Updates: If any changes are made to the travel arrangements after the final itinerary has been issued, clients will be notified promptly. Changes may be subject to additional fees and availability, and the updated itinerary will be provided accordingly.

It is the client’s responsibility to ensure that all travel documents, such as tickets, vouchers, and booking confirmations, are accurate and match the details on the final itinerary. Marvelux Getaways LLC. is not liable for issues arising from incorrect or missing documentation.

Travel Discrepancies: In case of any discrepancies between the final itinerary and the actual travel experience, clients should contact the relevant travel provider (e.g., airline, hotel) directly as well as Marvelux Getaways LLC.. Marvelux Getaways LLC. will assist in resolving issues to the best of our ability but is not responsible for any discrepancies or service issues.

Once Marvelux Getaways, LLC. has supplied a full digital itinerary that includes times for each necessary part of your trip, we are not responsible for late check-ins, missed activities or modes of transportation due to any kind of negligence of detail or failure to read emails. We can help, if possible, with rescheduling but all change / re-booking fees will apply.

All digital itineraries with travel documents will be provided to clients within 7 days after final payment or within 30 days (about 4 and a half weeks) of travel.

Disclaimer of Liability

All prices are invoiced to be available and current at the time of booking. The information, products, and services may include inaccuracies or typographical errors. Marvelux Getaways, LLC. does not guarantee the accuracy of, and disclaims liability for inaccuracies, including but not limited to the price, information, and description of the products and services described on this website. Changes to our client's departure dates, times or itineraries due to a supplier's / destination(s) mechanical, weather, world events, or other disruptions beyond our control are at the sole discretion of the supplier and may occur without notice. Any applicable compensation resulting from such occurrences is also at the sole discretion of the supplier.


Complaints and Dispute Resolution

  1. Filing a Complaint: If you have a complaint or issue regarding your travel booking or services provided by Marvelux Getaways LLC., please contact us as soon as possible. Complaints should be submitted in writing to Marveluxgetaways@gmail.com or through our online complaint form available on our website.

  2. Response Time: Marvelux Getaways LLC. will acknowledge receipt of your complaint within 1-3 business days. We aim to resolve complaints promptly and will provide a response within 3-5 business days from the date we receive all necessary information.

  3. Resolution Process: Upon receiving a complaint, Marvelux Getaways LLC. will investigate the issue and work towards a fair resolution. We may request additional information or documentation to fully assess and address your complaint.

  4. Escalation: If you are not satisfied with the initial resolution, you may request an escalation of your complaint to a senior representative of Marvelux Getaways LLC.. We will review the matter and provide a final response within 7 business days of the escalation request.

  5. Alternative Dispute Resolution: If a satisfactory resolution cannot be reached through our internal process, please stop using the services immediately..

  6. Legal Rights: Nothing in these terms affects your statutory rights as a consumer. You have the right to pursue legal remedies if you believe your complaint has not been adequately addressed through our internal procedures or alternative dispute resolution.
